Terms Of Service

These Terms & Conditions apply to all sales of goods and services supplied by VGS Performance Ltd (“we”, “us”, “our”). By placing an order or booking services, you agree to be bound by these terms.

Nothing in these Terms affects your statutory rights under UK law.


1. Prices

  • All prices include VAT (where applicable) at the prevailing UK rate.
  • Prices are correct at time of publication but may be amended without prior notice.
  • Prices exclude shipping, handling and installation unless expressly stated.

2. Discount Codes

  • Discount codes may be amended or withdrawn at any time.
  • We reserve the right to cancel or refuse discounts where misuse is suspected.
  • Discount codes are non-transferable and may not be combined unless stated.

3. VAT

  • VAT is charged at the prevailing UK rate (currently 20%).
  • VAT-registered European customers must order via email for VAT validation.
  • We do not accept orders outside the United Kingdom unless agreed in writing.

4. Payment

We accept:

  • Visa & MasterCard (credit/debit) via PayPal only
  • Bank transfer (contact us for details)

Cheques are not accepted.

For card payments, full billing details must be provided.

Orders over £100 may only be delivered to the billing address unless 3D Secure / Verified by Visa authentication is successfully completed.

We reserve the right to refuse any transaction where fraud is suspected.

5. Order Acceptance

All orders are subject to acceptance and availability.

We reserve the right to cancel or refuse any order including (but not limited to):

  • Pricing errors
  • Stock unavailability
  • Supplier failure
  • Suspected fraud

If cancelled prior to dispatch, a full refund will be issued. We shall not be liable for any further loss or consequential damages.

6. Dispatch & Delivery

  • Same-day dispatch for stocked items applies to weekday orders placed before 14:00 (GMT/BST).
  • Dispatch times are estimates and not guaranteed.
  • If urgent delivery is required, you must contact us before ordering.

We are not liable for courier delays outside our control.

7. Stock Availability

  • Live stock levels are not displayed on our website.
  • Not all items are held in physical stock.
  • Customers must confirm availability if goods are required for a specific date.
  • Do not book workshop installation until goods have been received and checked.

8. Right of Cancellation (Consumer Contracts Regulations 2013)

If you are purchasing as a consumer (not trade or business) via distance selling (online, phone, email), you have the right to cancel within:

14 calendar days from the day after receiving goods.

You must notify us in writing within this period. You then have a further 14 days to return the goods.

Conditions:

  • Goods must be unused, unfitted and in resalable condition.
  • You are responsible for return shipping unless goods are faulty.
  • We may deduct for diminished value caused by excessive handling.
  • Refunds are processed within 14 days of receipt of goods or proof of return.

9. Exemptions from Cancellation

The 14-day cancellation right does NOT apply to:

  • Special order or custom-made goods
  • Goods manufactured to customer specification
  • ECU tuning, remapping, coding or software once performed
  • Items sealed for hygiene reasons once unsealed
  • Business-to-business (trade) sales

10. Faulty Goods – Consumer Rights Act 2015

Goods must be of satisfactory quality, fit for purpose, and as described.

Within 30 Days: You may reject faulty goods for a full refund.

After 30 Days (Up to 6 Months): We are entitled to repair or replace before refund.

After 6 Months: You may need to demonstrate the fault existed at delivery.

Goods must be returned for inspection before any remedy is agreed.

We do not cover (unless legally required):

  • Labour
  • Removal/refitting costs
  • Recovery charges
  • Vehicle downtime
  • Consequential losses

11. Returns Procedure

  • You must notify us within 7 working days for non-fault returns.
  • A Returns Notice Number (RNN) must be obtained before returning goods.
  • Returns without an RNN will not be processed.
  • A copy of the invoice must be included.

Return shipping is the customer’s responsibility unless faulty.

We will not pay VAT, import duties or customs charges on returns.

Returns will not be accepted after 14 days (unless faulty under statutory rights).

12. Handling Charges

Correctly supplied goods returned outside the statutory cancellation period may be subject to a minimum 25% handling charge.

13. Special Orders & Modified Parts

  • Special order items are non-returnable unless faulty.
  • Items modified from original specification are non-returnable.
  • Painted products must be trial fitted before painting.
  • Parts showing signs of fitting, grease, sealant or damage will be refused.

14. Workshop & Installation Terms

  • Wheel bolts/nuts/studs must be rechecked after 25 miles following wheel removal. This is the owner’s responsibility.
  • Advisory notes on invoices may relate to safety or legal requirements.
  • We accept no labour claims under any circumstances.
  • Product and labour warranties are non-transferable.
  • Manufacturer warranty claims require return and inspection.
  • A valid invoice in the purchaser’s name is required.

15. Exchange Units & Surcharges

  • We may refuse exchange units deemed unserviceable.
  • Surcharges are refunded only once accepted by the supplier.

16. Retention of Title

All goods remain the property of VGS Performance Ltd until payment is received in full and cleared funds confirmed.

17. Old Parts

Old parts removed during installation will be disposed of after 5 business days unless collection is arranged.

Shipping of old parts can be arranged at the customer’s expense.

18. Finance

  • Finance is subject to credit and ID checks.
  • 0% finance available on selected purchases.
  • Goods supplied under finance must be delivered to the billing address on the credit agreement.

19. Performance & Motorsport Use Disclaimer

Many products supplied by VGS Performance Ltd are intended for performance, modified or motorsport vehicles. Such products:

  • May increase mechanical stress
  • May reduce component lifespan
  • May void manufacturer warranties
  • May not be road legal in all jurisdictions

It is the customer’s responsibility to ensure compliance with road traffic and emissions regulations.

We accept no liability for engine failure, transmission failure, vehicle damage, track use damage, or insurance invalidation where vehicles are modified beyond manufacturer specification.

20. Limitation of Liability

Nothing excludes liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability which cannot legally be excluded

Subject to this:

  • Our total liability shall not exceed the value of goods supplied.
  • We shall not be liable for indirect, incidental or consequential loss.
  • We shall not be liable for loss of profit, loss of business, or downtime.

21. Governing Law

These Terms are governed by English law and subject to the exclusive jurisdiction of the English courts.
